Workplace and WorkCover
We act for both employees and employers. Our work includes work injury claims, including disputes about liability, weekly payments and permanent impairment; unfair dismissal and general protections applications; discrimination and sexual harassment complaints; disputes about whether a person is an employee or a contractor; and claims for unpaid wages, superannuation and public holiday entitlements.
Wills, estates and probate
We prepare wills, including mirror wills and wills involving family trusts, business interests or the exclusion of a family member, together with enduring powers of attorney and advance care directives. For executors we apply for probate and administer estates through to distribution. We also act in family provision claims, disputes between co-executors and beneficiaries, and deeds of family arrangement.
Family law
We act in property settlements, including those involving trusts, companies, superannuation splits and inherited property, and prepare binding financial agreements before and after separation. We act in disputes about arrangements for children and in intervention order proceedings.
Conveyancing
Residential and commercial conveyancing, including off-the-plan purchases, building contracts, transfers between family members, and the related searches and enquiries. Conveyancing is attended to by Serena, who can be contacted at serena@corstonwither.com.au.
Property and leasing
Commercial and retail leases, including preparation, review, negotiation, renewals, variations, assignments and surrenders. We also act in disputes between neighbours, including boundaries, fencing, shared driveways and encroachment.
Building and construction
Building and construction contracts, including domestic building work, variations, delay and defect claims, and disputes between owners, builders and subcontractors. Progress payment claims and adjudication under security of payment legislation, and the recovery of retention monies.
Business, tax and insolvency
We advise on company and unit trust structures, including corporate trustees, and act in shareholder, partnership and business disputes. We draft and review commercial contracts, guarantees and settlement deeds. We advise on bankruptcy and liquidation, and on the associated tax, trust and superannuation questions.
Debt recovery
Recovery of unpaid invoices, loans and judgment debts, including letters of demand, statutory demands, court proceedings and enforcement by garnishee order, warrant of sale or charging order. We also act for those defending a claim or seeking to set aside a statutory demand.
Disputes and professional negligence
We act in civil disputes in the Magistrates and Supreme Courts of South Australia and in the federal jurisdiction, and in professional negligence claims and insurance disputes. We will give a view early about the merits of a matter, its likely cost, and whether a negotiated outcome would be preferable.
